What is a Lasting Power of Attorney?

A Lasting Power of Attorney (also known as a LPA) is a legally binding document, it involves a donor and an attorney. A donor is a person who allows another person to make a decision on their behalf. An attorney is a person who makes the decision on behalf of the donor. Decisions are usually based on the donor’s health, wealth and assets. There are two types of Lasting Powers of Attorney. These are property and affairs, and personal welfare.

Why have a Lasting Power of Attorney?

The reason why we have Lasting Powers of Attorney is because donors may be unable to make decisions for themselves due to mental incapacity, or health reasons therefore it’s important that they can appoint a trusted person to do this. A Power of Attorney is an individual document and therefore only one document applies per person. Each power of attorney is catered to meet specific needs. It is important these documents and the allocated attorney are agreed, and registered by the Office of the Public Guardian, before decisions can be made on finances and health.

What will it cost?

We provide a one-stop LPA service which includes preparing and registering your LPA with the Office of the Public Guardian.

There are 2 types if Lasting Powers of Attorney:

  • Health and Welfare;
  • Property and Finance.

Single Person LPA(s)

  • Health and Welfare LPA: £360 inc. VAT plus Court of Protection Registration Fee currently £82 (unless entitled to exemption or reduction in registration fee).
  • Property and Finances LPA: £360 inc. VAT plus Court of Protection Registration fee currently £82 (unless entitled to exemption or reduction in registration fee).

Buy both together and the cost is £600 inc. VAT plus Court of Protection Registration Fee for both (£82×2=£164) (unless entitled to exemption or reduction in registration fee).

What’s included?

  • Setting up your chosen LPA or both if you buy both;
  • Guidance on how to choose your Attorney and replacement Attorney;
  • Guidance on how to appoint your Attorney and replacement Attorney;
  • Guidance and assistance on signing your LPA;
  • Advising you on your Attorney’s duties;

 

  • Notifying your Attorney(s) and replacement Attorney(s);
  • Advising and completing any forms for reduction or exemption to Court fees;
  • Completing and Registering your LPA with the Court of Protection;
  • Providing a copy of your LPA to your Attorney(s) and storing your original LPA.

Couples LPA(s)

  • Health and Welfare LPA: £650 inc.VAT plus Court of Protection Registration Fee currently £82 each (total £164) (unless entitled to exemption or reduction in registration fee).
  • Property and Finances LPA: £660 inc. VAT plus Court of Protection Registration fee currently £82 each (total £164) (unless entitled to exemption or reduction in registration fee).

Buy both LPAs for each party and the cost is £1140 inc. VAT plus Court of Protection Registration Fee for each party for both LPAs (£82×4=£328) (unless entitled to exemption or reduction in registration fee).

What’s included?

  • Guidance and assistance on signing your LPAs;
  • Advising you on your Attorney’s duties;

What are our timescales for preparing your LPA?

From your initial instructions, we endeavour to have a draft LPA ready for your approval in 14 working days. We would then ask you to check and sign these before a witness. Your attorney(s) and any replacement attorney(s) will also need to sign the LPA before a witness. Once this is completed and returned to us, we will send your LPA to the Office of Public Guardian within 5 days of receiving this from you. The Office of Public Guardian can take between 4 to 12 weeks to register the LPA. We will inform you within 5 working days of receipt of notification from the Office of Public Guardian that your LPA has been registered.
